Hipcamp + REI Summer of Magic Official Rules


NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO REGISTER.


OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.


VOID IN ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.


Definitions

Hipcamp, Inc. 965 Mission St, 4th Floor, San Francisco, CA 94103 (“Sponsor”)

“Summer of Magic” – The Campaign coproduced by REI, Hipcamp and other participating brands.

“Magic Pass” – A Magic Pass unlocks access to three (3) tiers of prizes. This can include a free stay at a Hipcamp, “Hipcash” (credit towards a Hipcamp stay), products provided by REI, Hipcamp, and participating brands, and complimentary access to firewood, eggs, ice, and other camping supplies during a campout. Additional details provided below.


Eligibility

The Hipcamp + REI Summer of Magic Series (the “Campaign”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Void where prohibited or restricted by law.

The following individuals are not eligible to redeem a Magic Pass: (i) employees, representatives, agents, directors, and officers of the Sponsor, its parents, subsidiaries, affiliated companies, and marketing agencies, or of any other parties involved in the administration of the Campaign; (ii) employees, representatives, agents, directors, and officers of Recreational Equipment, Inc. (“REI”) , their parents, subsidiaries, affiliated companies, and marketing agencies (Hipcamp, and REI, along with the foregoing individuals and entities identified in (i) and (ii) are collectively referred to herein as, the “Campaign Parties”) and (iii) each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in the Campaign, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor, which shall be final in all matters relating to the Campaign. REI is not a sponsor and is not responsible for the administration of the Campaign, the collection or processing of entries, the selection of winners, or the fulfillment of Magic Passes.


Summer of Magic Entry Period

The Campaign begins on March 15, 2024, at 9:00 AM PDT and ends on August 31, 2024, at 9:00 AM PDT (“Entry Period”), but interim entry deadlines apply for each drawing that is held during the Entry Period. On a monthly basis beginning on or about March 13, 2024, and ending on or about August 31, 2024, Sponsor will select winners of the Magic Pass on a first come first served basis from all eligible entries received from the start of the Entry Period up to the date of the drawings. Sponsor will distribute up to one hundred (100) Magic Passes per drawing on the 15th of March, the 11th of April, and the first Wednesday of each month thereafter. Sponsor’s computer is the official time keeping device for the Campaign.


How to Enter

NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.

To enter, you must take the following steps:

Provide Sponsor with your full name and email address through the registration form available at hipcamp.com/magic (the “Entry Form”). Each entrant must register via this Entry Form for their entry to be valid. After you register via the Entry Form, you must then wait to be notified about the next drop of Magic Passes. Notifications will arrive via email and will include a link, which you must click through to opt-in and qualify for the next drop of Magic Passes. 


Non-winning entries will be required to opt-in for subsequent drops. You may only win once.


Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that do not comply with these entry requirements, as determined by the Sponsor in its sole discretion, or that do not meet the entry deadlines, will be disqualified from the Campaign.



Winner Selection and Notification

A maximum of twelve hundred (1,200) and a minimum of one hundred (100) entrants will be selected to receive a Magic Pass on a monthly basis. 


Sponsor will attempt to notify each winner by sending an email to the email address provided on the entrant’s Entry Form within 24 hours of the entrant clicking on the link in their drop notification email. In order to claim their Magic Pass, the winning entrant must respond to Sponsor’s email within twenty-four (24) hours after Sponsor sends the winner notification email to the entrant. 


Each winner is subject to verification, including verification of age and residency.


If a winner (i) is determined to be ineligible or otherwise disqualified by Sponsor, (ii) fails to respond to Sponsor’s first winner notification message within (a) 24 hours of notification (iii) fails to provide any information requested by Sponsor (e.g., information needed by Sponsor to fulfill the Magic Pass or for verification purposes) or timely execute and return any documents requested by Sponsor to accept the Magic Pass (e.g., any prize agreements required by Sponsor) (with such timeliness to be determined in Sponsor’s sole discretion), such winner will be disqualified and forfeit all interest in the Magic Pass (and for the avoidance of doubt, no compensation is due to winner from Sponsor). If a winner is disqualified, Sponsor reserves the right to either (A) select a substitute winner through a random drawing or (B) not award the unclaimed Magic Pass, in Sponsor’s sole discretion.


Magic Passes


Up to twelve hundred (1200) Magic Passes are available for the monthly drawings.


Each qualified winner of a monthly drawing will receive: (i) one Magic Pass. Approximate Retail Value will range from $10 to $1,000. Actual value may vary based on cost fluctuations and seasonal sales. Site stays are subject to availability. 


Winner will not receive the difference between actual and approximate retail value.


Magic Passes will vary in nature and will include the following:


The qualified winner of a Tier 1 Magic Pass will receive: (i) a one to two (1-2) consecutive night stay and up to four (4) guests at a winner-selected Hipcamp site (the “Destination”); and (ii) products selected by REI and participating partner brands. Approximate Retail Value: $1,000. Actual value may vary based on cost fluctuations and seasonal sales. Tier 1 Magic Pass winners will not receive the difference between actual and approximate retail value. Guests will be required to sign a release.


The qualified winner of a Tier 2 Magic Pass will receive: (i) products selected by REI and participating partner brands. Approximate Retail Value: $500. Actual value may vary based on cost fluctuations and seasonal sales. The Tier 2 Magic Pass winner will not receive the difference between actual and approximate retail value. 


The qualified winner of a Tier 3 Magic Pass will receive: (i) products selected by Hipcamp, which may include stickers, branded merchandise, firewood during a Hipcamp stay, s’mores, farm fresh eggs, and Hipcamp gift cards to be used toward a Hipcamp stay. Approximate Retail Value: $100. Actual value may vary based on cost fluctuations and seasonal sales. The Tier 3 Magic Pass winner will not receive the difference between actual and approximate retail value. 


Sponsor will not provide any transit or other assistance in connection with a Magic Pass. Each winner is solely responsible for travel to and from the applicable Destination, including without limitation any costs associated with such travel.


Winner is responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.


Sponsor is not liable for any travel canceled or Magic Passes forfeited due to a force majeure event (including without limitation, events related to the propagation of the COVID-19 virus or war).


The right to receive a Magic Pass cannot be transferred or assigned. No cash or other prize substitution is permitted, except at the sole discretion of the Sponsor. The Magic Pass is subject to availability and if the Magic Pass cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute the Magic Pass with one of comparable or greater retail value.


THE WINNER AGREES TO ACCEPT THE MAGIC PASS “AS IS”, AND ENTRANTS HEREBY ACKNOWLEDGE THAT Campaign PARTIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES OR THE CAMPAIGN, INCLUDING BUT NOT LIMITED TO (A) ANY EXPRESS WARRANTIES PROVIDED EXCLUSIVELY BY A PRIZE SUPPLIER THAT ARE SENT ALONG WITH THE PRIZE OR (B) THEIR QUALITY OR MECHANICAL CONDITIONS. SPONSOR HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.


Each Hipcamp gift card is subject to the terms and conditions that apply to such gift cards. By participating in the Campaign, participant acknowledges and agrees that such gift card shall be used only in compliance with such terms & conditions.


In order to use any Magic Pass at Hipcamp, the winner is required to create a Hipcamp account and accept the then-current Hipcamp Terms of Service. 


The winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the Magic Pass, and agrees to defend, indemnify, and hold harmless the Campaign Parties against any third-party claims for such taxes.


All costs and expenses associated with Magic Pass acceptance and use not specifically provided herein are the responsibility of the winner. Any details of Magic Passes not specified will be determined by Sponsor in its discretion.


Publicity

Except where prohibited by law, by accepting a Magic Pass, the winner hereby grants the Campaign Parties, and each of their representatives, an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, likeness, and information about the Magic Pass award, in any way, at any time, in any and all media, including without limitation, for use in advertising and marketing, without any additional approval, notification, compensation, or consideration. By accepting a Magic Pass, the winner represents and warrants that he or she has the right to grant the foregoing license.


Limitations of Liability of Campaign Parties


TO THE FULLEST EXTENT PERMITTED BY LAW, EACH ENTRANT AGREES (I) THE CAMPAIGN PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES, LIABILITY, OR INJURIES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURIES OR DEATH, ARISING OUT OF OR CONNECTED WITH (A) THE Campaign OR (B) ANY PRIZE AWARDED, ACCEPTED, POSSESSED, MISUSED, DELIVERED, OR USED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE Campaign ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES, IF ANY, TO ENTER THE Campaign (BUT IN NO EVENT ATTORNEYS’ FEES). 


The Campaign Parties assume no liability and are not responsible for, and by entering the Campaign you hereby waive and release the Campaign Parties from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Campaign and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, mobile device, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Campaign, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Campaign. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only a single prize from a random drawing of all eligible entries. In no event will more than the stated number of prizes be awarded.


LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE Campaign IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 


Sponsor may prohibit an entrant from participating in the Campaign or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Campaign by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Campaign Parties.


Sponsor’s Reservation of Rights

If the Campaign is not practically capable of running as planned for any reason outside the control of the Sponsor, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, war, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Campaign, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Campaign. In the event of cancellation, Sponsor reserves the right to select a winner from a random drawing of all non-suspect, eligible entries submitted as of the time of cancellation.  


Governing Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and the winner, and the rights and obligations of the Sponsor in connection with the Campaign, shall be governed by, and construed in accordance with, the laws of State of Minnesota, without giving effect to any choice of law or conflict of law rules. Any action at law or in equity arising out of or relating to the Campaign, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of Minnesota, and the entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.


Privacy

Any personally identifiable information collected during an entrant’s participation in the Campaign will be collected and used by Sponsor and REI, and their respective designees, for the administration and fulfillment of the Campaign and as otherwise described in these Official Rules, Sponsor’s privacy policy available at https://www.hipcamp.com/en-US/privacy. Entrants’ entry information will be shared with REI, in which case such information will be respectively subject to REI’s privacy policy available at https://www.rei.com/help/privacy-policy. Each entrant irrevocably consents to (i) the use of Entrant’s entry information by Sponsor and REI for business purposes, and (ii) being added to email lists maintained by Sponsor and REI.


Winner List

For any legally-required list of winners, or a copy of the Official Rules, mail your request to Hipcamp, Inc. 965 Mission St, 4th Floor, San Francisco, CA 94103, together with a self-addressed stamped return envelope (Residents of Vermont can omit return postage for Official Rules requests), prior to the end of the Entry Period for a copy of the Official Rules, or within sixty (60) days after the end of the Entry Period for the list of winners.
